Please read below the terms and conditions that apply to all reservations, bookings and stays at Winston B&B. By reserving a room or staying with us, you agree to these terms and conditions. This way, you know in advance exactly what you can expect from us and which agreements apply to your stay.

These terms and conditions apply to all offers, reservations, bookings and stays at Winston B&B. By reserving a room, making a booking or staying in one of the rooms offered by us, you agree to these terms and conditions.

1. Rates and offers
‍All listed rates are subject to availability and may change. The price of a stay may depend, among other things, on the selected date, the number of nights, the room type, the number of guests and any promotions or packages.

Special offers are valid temporarily and are always subject to availability.

Although Winston B&B strives to display all information, prices and availability as accurately as possible, errors, typing mistakes or omissions may occur. Winston B&B is not liable for obvious errors or mistakes and reserves the right to amend or correct information, rates or availability.

2. Bookings through external providers
‍When a reservation is made through an external provider, booking platform or Online Travel Agency, different terms, prices, payment conditions and cancellation conditions may apply.

The guest is responsible for carefully reading the terms and conditions that apply with the relevant external provider or booking platform.

In the event of a conflict between these terms and conditions and the terms and conditions of an external provider, the terms under which the booking was made through the external provider will, in principle, apply to that specific booking.

3. Reservations and bookings
‍Reservations can be made online, verbally, by telephone or by email.

A reservation is only final once it has been confirmed by Winston B&B. Without confirmation from Winston B&B, no claim can be made to the reservation.

When you book one or more rooms at Winston B&B, you agree to these terms and conditions.

Unless expressly agreed otherwise, no additional reservation fees will be charged.

4. Payment
‍Payment must be made upon arrival at Winston B&B, unless otherwise agreed in writing in advance.

Payment is made in euros. Depending on the available payment methods, payments can be made in cash, by debit card, credit card or by invoice.

Changes in the VAT rate or other statutory charges may be passed on to the guest at any time.

When payment by invoice has been agreed, the invoice must be paid within the stated payment term. For national invoices, a payment term of 14 days applies. For international invoices, a payment term of 5 days applies, unless otherwise agreed in writing.

If payment is not made within the stated period, Winston B&B reserves the right to hand over the claim to a collection agency. Any additional collection costs, interest and other costs may be charged to the guest or client.

5. Cancellation and no-show
‍If a guest is unable to honour a booking, we ask the guest to inform Winston B&B as soon as possible and in full.

Cancellations are accepted up to 24 hours before the booked arrival date, unless expressly agreed otherwise or unless different cancellation conditions apply to the booking.

In the event of cancellation within 24 hours before the arrival date or on the day of arrival, 100% of the agreed price will be charged.

In the event of a no-show, 100% of the reservation amount will also be charged.

If a guest departs earlier than originally agreed, no refund will be made of the amount already paid or due.

For reservations for accommodation on a specific date, there is no statutory right of withdrawal. The cancellation conditions stated with the booking and in these terms and conditions apply.

6. Arrival and departure
‍Check-in is possible from 3:00 PM on the day of arrival, unless expressly agreed otherwise.
Check-out must take place before 10:30 AM on the day of departure, unless expressly agreed otherwise.

The front door and the room(s) are accessible with a personal access code for the electronic lock. This access code is provided to the guest on the day of arrival.

The access code is personal and may not be shared with third parties. The guest is responsible for careful use of the provided access code.

7. Breakfast
‍Breakfast is offered to B&B guests from Monday to Sunday between 8:00 AM and 10:30 AM.

Different breakfast times are only possible if this has been discussed and confirmed in advance with Winston B&B.

8. House rules
‍To keep the stay pleasant and safe for all guests, the following house rules apply within Winston B&B:
‍
- Smoking is not permitted inside the accommodation.
- Pets are not permitted, unless otherwise agreed in writing in advance.
- Guests must show consideration for other guests, employees and local residents.
- Nuisance, aggressive behaviour, vandalism, drug use, misuse of facilities or other undesirable behaviour will not be accepted.
- The accommodation, rooms, inventory and communal areas must be used neatly and carefully.
- Guests are responsible for damage caused by themselves, their fellow guests or visitors.

It is not permitted to use Winston B&B as a BRP address, residential address, postal address or registration address. The Municipality of Eindhoven does not grant permission for this.

9. Refusal, removal and termination of stay
‍Winston B&B reserves the right to refuse guests, deny access or terminate the stay immediately if a guest violates these terms and conditions or house rules, causes nuisance, causes damage or behaves in such a way that order, peace, safety or business operations are disrupted.

In such cases, the guest is not entitled to a refund of amounts already paid or to compensation for any costs.

Winston B&B is entitled to terminate the accommodation agreement without notice if the guest repeatedly violates the house rules or behaves in another unacceptable manner.

10. Damage, loss and liability
‍Winston B&B is not liable for damage, injury, loss or theft of guests’ belongings, unless there is intent, gross negligence or liability that cannot be excluded under mandatory law.

Guests are responsible for their personal belongings and must handle the accommodation, room, access codes, inventory and other facilities with care.

All damage, accidents, defects or incidents must be reported immediately to the manager or responsible employee of Winston B&B.

Damage caused by a guest, fellow guest or visitor to the accommodation, inventory, room or property of Winston B&B will be financially recovered from the responsible guest or client.

11. Camera surveillance
‍Winston B&B may use camera surveillance to protect guests, employees, property and the accommodation.

Camera footage may be used when necessary in connection with vandalism, theft, burglary, violence, nuisance, damage, safety incidents or other legal violations.

Camera footage is not retained longer than necessary and is only shared when legally required or necessary for, for example, the police, judiciary, insurers or other competent authorities.

12. Force majeure
‍Winston B&B is not liable for damage or costs resulting from force majeure. Force majeure includes, among other things, fire, water damage, power failure, technical failures, government measures, illness, strikes, extreme weather conditions, safety risks or other circumstances over which Winston B&B reasonably has no control.

If Winston B&B is unable to carry out a reservation due to force majeure, a suitable solution will be sought in consultation with the guest.

13. Complaints
‍Any complaints about the stay, the room or the service must be reported to Winston B&B as soon as possible during the stay. This gives Winston B&B the opportunity to assess the complaint immediately and resolve it where possible.

Complaints reported only after departure may no longer be fully investigated or resolved.

14. Applicable law
‍These terms and conditions and all agreements with Winston B&B are governed by Dutch law.

Disputes will preferably be resolved by mutual consultation. If this proves impossible, the dispute may be submitted to the competent court in the Netherlands.

15. Changes to the terms and conditions
‍Winston B&B reserves the right to amend these terms and conditions. The most recent version of the terms and conditions always applies and will be published on the Winston B&B website.
